Abstract

This paper aims to highlight the role of discourse performativity in civil disobedience. It also aims to clarify the place of civil disobedience in contemporary democracies. As we wish to argue, civil disobedience, far from denying the rule of law, vindicates constitutional foundations and is capable of subjecting unjust laws and norms to doubt. This reflective exercise takes as a starting point the contractualist theory as a modern foundation of the obedience of the rule of law, to later establish a contemporary view, from the hand of the updates of the theory made by authors such as Hannah Arendt, John Rawls and Jürgen Habermas.
