Norms and Principles: A theoretical inquiry into the transcendence of values in Law.

The relevance of values in law is examined through arguments that highlight the need to incorporate axiological elements—particularly legal principles—into a predominantly positivist framework. Such elements are capable of guiding normative conduct without reliance on coercion, traditionally understood as the primary mechanism through which the State enforces legal norms. From this standpoint, the defining features of legal norms are outlined and subsequently contrasted with those of principles. This approach seeks to show that, in a context marked by the weakening of the rule of law, reorienting legal education toward a conception grounded in substantive ideals that give meaning to community life becomes a pressing necessity.
